Rev: 16-20250822
IMPORTANT NOTICE: The translated versions of the contracts and legal policies are provided solely as a convenience to facilitate reading and understanding of the Spanish versions. The objective of providing translations of contracts and legal policies is not to create a legally binding contract, and not be a substitute for the legal validity of the Spanish versions. In the event of any dispute or conflict, the Spanish versions of the contracts and legal policies will under all circumstance govern our relationship and prevail over the terms in any other language.

The purpose of this document is to define the Specific Contract Terms for the provision of mediation services for domain name registration to be specified later, and they are considered a supplement to the General Contract Terms published and in force at any given time on the website www.dondominio.com. Both these Specific Terms and the General Contract Terms will be understood to be expressly and jointly accepted when contracting the services offered on the website www.dondominio.com. In case of any discrepancy between these conditions and the general conditions, the specific conditions will take precedence.

The General and Specific Conditions, together with the additional information on the technical and/or economic characteristics of the product or service contracted by the Customer and the Personal Data Protection Policy published on the DonDominio website, constitute a unified set that binds the parties.

1. Identification of the parties signing this agreement.

(hereinafter identified by the trademark “DonDominio”), with N.I.F. number B57333601 and domiciled at C/ Menestrals, 14, Manacor-07500, Illes Balears, Spain, a Limited Liability Company established in Palma de Mallorca before Notary D. Contract: all the clauses contained in this document, along with the contracting form, as well as any additional information regarding the specific service contracted, chosen by the CUSTOMER, are collected in an updated and express manner, on the DonDominio website (www.dondominio.com), forming a unified set that binds the parties. THE REGULATIONS ESTABLISHED BY THE COMPETENT REGISTRARS (of the second or third level Domain Names under the corresponding extension) WILL BE MANDATORY and may condition the way DonDominio provides the service; moreover, this regulation will serve as an interpretation for the clauses of this contract in everything that affects the Domain Name, registration, transfer, conflict resolution, change of ownership, change of registrar, but will not affect the contractual relationship created between DonDominio and the CLIENT.

2.12. Change of DNS: the technical transfer of the DNS of a Domain Name is understood as a DNS change.

2.13. Billing Contact: natural or legal person responsible for paying the domain to the corresponding Registrar.

2.14. Technical Contact: natural or legal person optionally designated by the Registrant. Only their email address and phone number will be collected, according to the ICANN Registration Data Policy (21/02/2024)

2.15. ICANN (Internet Corporation for Assigned Names and Numbers): nonprofit corporation formed to assume, among other functions, the responsibility for IP address location, protocol assignment, management of Domain Name systems and servers; in short, ensuring the operation and stability of the network.

2.16. WHOIS: an interactive public access tool on the Internet that provides information about the ownership, contact details, and availability of a Domain Name or IP address.

2.17. Sunrise Period and Landrush Period: consist of different pre-registration time periods, determined by the competent Registry according to the Domain Name. These are periods before the definitive start of the registration process of the corresponding Domain Name, during which special rules, also set by the Registry, must always be respected by the domain name holder.

2.18. Client Area: a tool developed by DonDominio that is assigned to each CLIENT and allows them, among other actions, to contract and manage their products, consult issued invoices, update their billing data, access the control panel, and make authenticated requests, so that each order triggers the necessary technical and administrative actions for the development of the required action.

3. Purpose

3.1. This document is intended to define the Specific Contract Terms for DonDominio's provision of the mediation services necessary to request, on behalf of the Client or the person it designates, the registration and/or transfer of a second-level Domain Name corresponding to any of the extensions published at any time on the Domains site, (henceforth, “the Extensions”), as well as the manner of remuneration of the Client to DonDominio for the service rendered.

4. Policy on registration, transfer, and renewal of domain names

4.1. DonDominio, under this contract, undertakes to perform the corresponding managements, always respecting the norms and terms established by each Registry, aimed at the Registration, transfer, and/or renewal of the Domain Name under one of the Extensions chosen by the Client.

4.2. The Holder and/or CLIENT authorizes DonDominio, in its capacity as accredited registrar, to collect, process, and transfer only the strictly necessary personal data - limited to those listed in Annex I-, with the exclusive purpose of managing the registration, transfer, or maintenance of the Domain Name, in accordance with ICANN's Registration Data Policy and the applicable data protection regulations.

4.3. The current regulations that each Registry applies to each of the EXTENSIONS and that will be mandatory for the CLIENT as well as the price to satisfy each of the registrations can be consulted at any time in Domains

4.4. The CLIENT accepts that the registration of the Domain Name subject to this contract does not confer any ownership rights over it, except to use it always respecting the ICANN regulations and the obligations contained in this contract.

4.5. The CLIENT accepts that it is solely responsible for the choice of this Domain Name and its subsequent maintenance.

4.6. The CLIENT acknowledges that neither the registration of the Domain Name nor the way it is used, both directly and indirectly, infringes third-party rights and that, furthermore, said Domain Name is not being registered for illegal present or future use. In this sense, the CLIENT acknowledges that the ultimate ownership and responsibility for the use of the Domain Name lies with whoever is included as the domain's owner.

4.7. The CLIENT will receive, at the email address specified by themselves in the contracting form as a contact address, notification of the fact that their request has been successfully processed before the competent Registry.

4.8. The holder and/or CLIENT acknowledge and accept that the operability and functioning of the IDNs are in a provisional phase, pending their complete technological adaptation, so they may vary depending on the type of browser and email program used in each case, requiring some of them to download an application that adds this technical feature.

4.9. The holder and/or CLIENT agree not to change the Registrar within sixty (60) days from when the initial registration was made or the last registrar change occurred. In either case, DonDominio does not guarantee the change of registrar because it is the former registrar who must provide the final authorization.

4.10. If a .lu domain transfer is initiated and must be restarted because it was not accepted within the time indicated by the Registry or because it was canceled, a non-refundable charge of 4 euros for management fees will be made.

4.11. Once the Domain Name is registered or transferred to DonDominio, it will be responsible for the renewal, charging the determined price for this purpose according to clause 5 of these Conditions. DonDominio will not be responsible for renewals not being carried out correctly due to reasons attributable to the competent bodies.

4.12. The CLIENT may mark the domains with the auto-renewal functionality from their Client Area. In the event of an account balance, domains with this functionality activated will be renewed thirty (30) days before their expiration date. It is not possible to cancel the renewal of a domain once processed.

4.13. Although DonDominio will inform the CLIENT and/or holder of any modifications that competent organizations may make to the characteristics and duration of these periods, the valid information governing this point can be consulted in Domains under information of each of the EXTENSIONS.

4.14. Change of ownership and other data of the Domain Name: the CLIENT must meet the requirements and perform the requested actions by DonDominio, in addition to sending the necessary documentation according to the indications of the competent Registry.

4.15. By filling out the form for the registration, transfer, or change of ownership of a Domain Name -or any other equivalent operation-, the Holder and/or CLIENT understand that the collection of their data and its transfer to the competent Registry Operator, as well as its limited transfer to the RDDS service of the data listed in Annex I, will be carried out exclusively following ICANN's Registration Data Policy and applicable data protection regulations.

4.16. If the Domain Name holder does not match the CLIENT, it will be their responsibility to obtain the first's consent for the obligation, among others, referred to in the previous paragraph, ensuring all consequences that failure to comply with this obligation could generate.

4.17. The search for a Domain Name may contain errors as the resulting information is electronically generated from multiple data sources. DonDominio is not responsible in any case for the search results, having solely an informative character.

4.18. The CLIENT acknowledges that DonDominio cannot guarantee that they will obtain the registration of the desired Domain Name, even if a query indicates that the Domain Name is available at the time of their request.

5. Prices.

5.1. Registration, renewal, and transfer: The prices governing this contract can be consulted at any time in Rates and Volume Discounts.

5.2. Change of ownership and other data of the Domain Name: In most EXTENSIONS, the price of these processes is free of charge since the CLIENT performs it from their Domain Administration Panel, but some Registries have set an additional rate to carry out a change of ownership (TRADE). If applicable, the CLIENT will be previously informed, via online communication, of the fee that must be paid to make such a modification.

5.3. DonDominio reserves the right to review and modify the amount of the prices stipulated on the website www.dondominio.com and included in this contract. Should this occur, the Customer will be informed of this circumstance before being affected by the variation in the next invoice.

5.4. All prices appearing on the DonDominio website and mentioned in the different sections of this contract are subject to the corresponding taxes.

**6. Payment method and billing

6.1. The payment for the services subject to this contract is in advance, and DonDominio will accept the following payment methods:

  • Credit/debit card

  • PayPal

  • Bizum

  • Bank transfer

6.2. The CLIENT will decide, in any case, which payment method they wish to use to make the payment for the registration or renewal of the Domain Name.

6.3. DonDominio will inform of the need for Domain Name renewal to the CLIENT before the expiration of the Domain Name expiration deadline. If the payment is not made in advance, DonDominio will not be responsible for any consequences that the loss of the Domain Name may bring from this fact.

6.4. The necessary data to make the bank transfer to enter balance in the account can be verified once the CLIENT is registered in the Client Area > My Data > Insert Balance in account. The balance in the account for bank transfer or direct debit will not be effective until the bank has confirmed these operations.

6.5. DonDominio will not initiate the corresponding request managements unless it receives the payment amount for these services through the means indicated in each case.

6.6. DonDominio will issue the corresponding invoice detailing all the concepts that make up this invoice.

6.7. In the case of a Client's default resulting in the bank return of any collection or debit order, DonDominio will charge an additional fee of 3 euros in management fees in case of reissuing said collection or debit order. DonDominio will not be responsible for said default, resulting in the non-registration and/or non-renewal of the Domain Name.

6.8. If, after prior notice, the CLIENT does not make their pending payment, they will definitively cease the service due to breach of contract on their part. This will prevent the CLIENT from contracting new services with DonDominio, canceling their CLIENT account, and all contracted services.

6.9. If the Client requests a refund of their "Balance in Account," a bank transfer will be made, unless it can be returned through the same payment method used for insertion, to the account number indicated by the Client, deducting 3 euros as management fees. If "Balance in Account" has been used and a refund is requested, it will be made 60 days from the last date of account balance entry.

7. Entry into force, duration, and extension

7.1. This contract will come into force upon payment for the requested service upon completing the contracting form and will remain valid for one year from the registration of the selected Domain Name. If the Domain Name were transferred to another registrar, the terms and conditions of this contract would lose their validity.

7.2. In the case of transferring a Domain Name to DonDominio, the year will begin counting from the expiration date of the Domain Name subject to the service that appears in the WHOIS.

7.3. The effects of the service subject to this contract, after the one-year duration, will be renewed and the renewal procedures carried out whenever the CLIENT so wishes and pays the renewal in advance, as indicated in clause 6.3 of this contract when informed of the expiration of the Domain Name period.

8. Right of withdrawal

8.1. In relation to the provisions of the Spanish regulations for consumer and user protection, and Directive 2011/83/EU of the European Parliament and of the Council of October 25, 2011, the CLIENT is informed, and they expressly accept, that given the characteristics of the services contracted, their personalization and the automated processes used, create a simultaneity between the service request and the start of contract performance.

8.2. In this sense, once DonDominio has started the contract performance or it has been fully executed, the CLIENT cannot choose to withdraw from the contract set out in the mentioned regulations.

9. Obligations and responsibilities.

9.1. DonDominio acts as an intermediary, before the competent bodies and the CLIENT (and/or holder), performing the appropriate managements for the registration, transfer, and/or renewal of the Domain Name, as the case may be. DonDominio is not responsible for the Domain Name chosen being effectively registered even when it is available at the time of concluding this contract. Nor will it be held responsible for the renewal being effectively done even when all appropriate managements have been made by DonDominio and established by the competent Registrars.

9.2. DonDominio will only be liable in cases where registration or renewal is not carried out due to DonDominio's negligent action. In these cases, DonDominio will take the appropriate steps to register another Domain Name requested by the affected owner or, at the request of the CLIENT, the amount of money they had advanced for obtaining this service will be refunded to them. For this reason, the CLIENT and/or Domain Name holder hereby expressly renounce claiming any liability, contractual or non-contractual, damages, and losses to DonDominio for not obtaining the registration or renewal of the affected Domain Name, without prejudice to the exercise of legal actions that may correspond to them before the competent body.

9.3. The CLIENT assumes all responsibility that may arise concerning the rights of use of the chosen Domain Name.

9.4. The CLIENT accepts the rules and conditions imposed by all organizations regulating Internet Domain Names.

9.5. The CLIENT accepts that the registration of the Domain Name subject to this contract does not confer any ownership rights over it, except to use it always respecting the ICANN regulations and the obligations contained in this contract.

9.6. The CLIENT accepts that they are solely responsible for the choice of this Domain Name, for its subsequent maintenance, and undertakes not to use it for illicit purposes, present or future, not to use it at the expense of the rights of third parties, exempting DonDominio from any liability arising from these acts.

9.7. DonDominio is not responsible for what is exclusively attributable to the CLIENT and/or holder, nor what is attributable to the competent Registrar's performance, as well as for errors resulting from the registration process.

9.8. In its case, DonDominio's liability will be limited to the amount of the registration fee applicable at the time the dispute arises.

9.9. DonDominio reserves the right to suspend or cancel the CLIENT and/or owner's Domain Name when the same is used to send unsolicited commercial advertising, or if the owner uses the Domain Name to conduct illegal activities or those that, at DonDominio's discretion, may involve any form of liability.

9.10. Responsibility for the Contents hosted under the registered domain name. The CLIENT agrees not to register a Domain Name under which contents that violate the principles set out in Article 8 of the Information Society Services and Electronic Commerce Act (LSSICE); mainly, those that undermine human dignity and/or are discriminatory by reason of race, sex, religion, opinion, nationality, disability, or any other personal or social circumstance.

  • In the event that DonDominio, by itself or at the request of a third party entitled to rights or authorized to do so, becomes effectively aware that the contents hosted by the CLIENT under the registered domain name violate personality, intellectual, industrial property rights or any other established by law, DonDominio may require the CLIENT, through communication to the email provided by the CLIENT for billing to voluntarily remove the contents within 24 hours.

  • In such a case and after this period without the request being met, DonDominio will proceed to immediately suspend the necessary service or services, which will not be resumed until the request is met on the terms necessary in each case. The Customer may not claim for this cause the refund of any amounts previously paid as a payment of the service, nor hold DonDominio responsible for the suspension, and if applicable, cancellation definitive of the service.

9.11. If the CLIENT and/or owner breaches any of the obligations contained in these specific conditions, DonDominio reserves the right to suspend or cancel the owner's Domain Name.

9.12. DonDominio reserves the right to block, deny, cancel or transfer any Domain Name whenever, in its judgment, it is necessary to:

  • comply with applicable legislation, comply with legal requirements, and in the fulfillment of any dispute resolution procedure,

  • avoid any civil or criminal liability from DonDominio, the Registrar, the Registry, and its respective employees,

  • correct errors made by DonDominio, the Registrar or the Registry, regarding the Domain Name, protect the integrity and stability of DonDominio, the Registrar, and the Registry.

9.13. DonDominio does not guarantee the usefulness of choosing the Domain Name or any of the extensions offered in Domains for doing any specific activity.

9.14. If the Domain Name's holder is not the CLIENT, they must inform them of all obligations pertaining to the Domain Name's holder and obtain their consent when requested by the competent entities.

9.15. The CLIENT and/or owner, as the case may be, of the Domain Name must always comply with the requirements demanded by the corresponding Registry and ICANN, not being able to claim to DonDominio damages arising from their non-compliance. If any dispute arises over rights of use of the chosen Domain Name, the holder and/or the CLIENT, as the case may be, agree to resolve them through the instances and procedures established by the competent Registry according to the case.

9.16. The CLIENT undertakes to keep the email address provided in the contracting form for communications with DonDominio operational, active, and updated, as it is DonDominio's preferred communication means for the quick and efficient management of the requested service. If the CLIENT wishes to change the email address provided in the contracting form as a contact address, they must do so through the Client Area, with its authentication measures for such a request, so that communication between both contracting parties is not interrupted at any time. DonDominio will not be responsible for the consequences that may result from the lack of operability of the CLIENT's contact email address or for the lack of communication that the change of non-updated address may cause, as well as for the disinformation alleged by the CLIENT due to their own negligence in keeping this data active.

9.17. If the CUSTOMER and the holder do not match, if DonDominio receives one request from the CUSTOMER and another distinct one from the holder (duly accredited) about the same Domain Name, regardless of the nature of the request, the CLIENT consents and accepts that DonDominio will attend the request from the holder since the right of use and referenced obligations of use with competent entities rest with the holder.

9.18. The liability for the use and conservation of the Login and password of the Client Area falls solely on the CLIENT. The use of these identifiers and their communication, even to third parties, is under the sole responsibility of the CLIENT.

9.19. The holder and/or CLIENT must respond within a maximum of fifteen (15) calendar days to any request from the corresponding registrar regarding updating the data provided for the Domain Name registration. Failure to comply may result in the Domain Name being canceled or deactivated. By accepting this contract, the CLIENT expressly consents to issuing service-related invoices through telematic means, as provided by current regulations in this matter.

10. Conflict resolution.

10.1. The CLIENT and/or holder agree to accept any possible arbitration requirement for registering a Domain Name and to submit to the ICANN-approved Domain Name conflict resolution regulations, including resolving disputes arising during the so-called Sunrise Period and Land Period, referred to in these latter cases as "Sunrise Dispute Resolution Policy."

10.2. This regulatory framework for Domain Name conflict resolution (DOMAIN NAME DISPUTE RESOLUTION POLICY) links this general Domain Name contract and states the terms and conditions regarding a dispute between the holder and another party, different from DonDominio, about the registration and use of an Internet Domain Name registered by the CLIENT and/or holder.

10.3. The actions shall be carried out following the Uniform Domain Name Resolution Policy adopted on August 26, 1999, by ICANN available at https://www.icann.org/resources/pages/policy-2012-02-25-es, the additional rules of the selected administrative dispute resolution service provider and, in each case, those that may correspond by reason of the territorial code corresponding to the disputed Domain.

10.4. Neither DonDominio, the Registrar, nor the corresponding Registry will be responsible for the damages that may be caused if a Domain Name becomes involved in a dispute resolution process, both technically and administratively, or for its result. DonDominio will not act as an arbitrator for disputes between the CLIENT and third parties for the use of the Domain Name.

10.5. The CLIENT and/or holder, for resolving Domain Name disputes, in accordance with their regulatory provisions, will submit, without prejudice to any other jurisdiction that may be applicable to them, to the jurisdiction of the courts of the holder's domicile (according to data with the Registrar) or the domicile of the principal office of the registrar.

10.6. This agreement has been written in versions in English, Catalan, and Spanish. In case of discrepancies, the Spanish version shall prevail.

11. PERSONAL DATA PROTECTION POLICY.

11.1. Regarding personal data provided by the Client to DonDominio for the contracting and economic management of Services and inquiries or communications of any kind related to their management, the Personal Data Protection Policy published at the following link: Mediation contract for the Registration of Domain Names will apply.

11.2. Personal data provided by the client will be communicated to the competent National or International Registering Authority or Body, responsible for registering the Domain Name in question, and such communication is necessary for the execution of this contract. For this purpose, the applicant undertakes to keep the information provided updated using the procedure established for this purpose.

11.3. These Entities will observe, in the treatment of the client's personal data, what is specified in the General Data Protection Regulation (Regulation EU 679/2016), not using them for purposes other than those provided for in the rules governing the assignment of domain names under the extension that corresponds in each case and in this contract.

11.4. The Registrar will exclusively process the data listed in Annex I - Essential data for executing this contract and ensuring the integrity and stability of the Domain Name System (art. 6.1 b RGPD) and in its legitimate interest in preventing abuse (art. 6.1 f RGPD).

11.5. The Registrar will keep encrypted logs of all disclosure requests and resolutions according to the Registration Data Policy, preserving them during the same 15-month period.

11.6. By default, the Registrant's personal data will remain redacted in the RDDS; only the fields provided for in the Registration Data Policy will be displayed.

11.7 Data requests for non-public access will be processed according to Annex II – Non-public data disclosure procedure.

11.8 Data will be kept 15 months after cancellation or transfer, unless legally obligated to keep them longer.

11.9 When the Register Operator or another authorized recipient is established outside the European Economic Area, DonDominio will ensure that the international data transfer necessary - limited to those listed in Annex I - is executed in full compliance with articles 44 and following of the RGPD, by subscribing to the 2021/914/UE Model Contract Clauses and, if applicable, adopting the additional security measures required by control authorities or ICANN's Registration Data Policy.

11.10. The rights of access, rectification, deletion, and data portability and the limitation or opposition to its treatment may be exercised against DonDominio following its Personal Data Protection Policy Mediation contract for the Registration of Domain Names or in the case of ".es" domains before the entity Red.es as the data processing responsible. In this particular case, cancellation and opposition rights can only be exercised after resignation from the requested domain name since data processing by Red.es is necessary for domain name assignment and renewal.

11.11 The interested party can exercise their rights through dpo@scip.es

12. Explicit Acceptance of these Conditions

12.1. These Specific Conditions, the General Contract Terms, the technical information of the services, and the Personal Data Protection Policy, are included in the DonDominio services contracting process selected by the CLIENT, expressly accepting the entirety of its content by contracting the services.

12.2. Activating the sending request button through the DonDominio website attributes the condition of "CLIENT" and expresses the full and unreserved acceptance of the Contract Conditions for the Services requested in the version that DonDominio makes available electronically before activating the CONTRACTING button.

12.4. This agreement has been written in versions in English, Catalan, and Spanish. In case of discrepancies, the Spanish version shall prevail.

13. Limitation of warranty and liability

13.1. In no case, neither DonDominio, the corresponding Registries, nor its executives, administrators, managers, shareholders, agents, or subordinate workers will incur any liability for any cause directly or indirectly related to the use made by the CLIENT and/or owner of the Domain Name use.

13.2. The holder of a Domain Name and, subsidiarily, the CLIENT, when the roles do not coincide, agree to indemnify, defend, hold harmless and release from any type of liability both DonDominio and the competent Registry, as well as their directors, officers, employees, agents, and affiliates of all claims, damages, liabilities, losses, etc., including reasonable legal fees and expenses generated or related to the registration of the holder's Domain Name. This obligation will survive the termination of the contract.

13.3. The parties acknowledge that the coming into force of this contract does not involve any representation, delegation, warranty, or other agreements other than those explicitly described in this contract; therefore, all terms, conditions, warranties, or other aspects implied by conventions or general regulations are explicitly excluded to the limits permitted by law.

14. SPECIAL REGULATIONS

For the registration of certain EXTENSIONS of Domain Names, a series of special regulations must be met that can be consulted on the specific page of each of the EXTENSIONS at Domains.
